¶2No one appears on behalf of the appellant to press this appeal. Sri Bade Lal Bind, learned counsel for the State is present, who has been heard.

¶3The present appeal has been filed by the appellant-Chhotey, against the judgement and order dated 15.11.1994 passed by Special Judge (D.A.A.), Etah in Special Session Trial No. 158 of 1989, (State vs. Chhotey), under Section 412 IPC, P.S.- Kasganj, District Etah.

¶4As per office report dated 31.10.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 17.07.2020 informed that the appellant-Chhotey has died. The said report has been sent after due enquiry.

¶5Accordingly, the appeal stands abated.
