¶2No one appears on behalf of the appellant to press this appeal. Sri Bade Lal Bind, learned counsel for the State is present, who has been heard.

¶3The present appeal has been filed by the appellant-Rajesh, against the judgement and order dated 25.11.1994 passed by VIth Additional Sessions Judge, Saharanpur in Session Trial No. 428 of 1993, (State vs. Rajesh and Others), under Section 324 IPC, P.S.- Janakpuri, District Saharanpur.

¶4As per office report dated 31.10.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 05.08.2020 informed that the appellant-Rajesh has died. The said report has been sent after due enquiry.

¶5Accordingly, the appeal stands abated.
