By means of the present application under Section 483 Cr.P.C., the applicant has sought for a suitable direction to the learned Additional Chief Judicial Magistrate, Auraiya to consider and decide the Complaint Case No. 975 of 2017 (Satya Narayan Dixit Vs. Manoj Kumar Mishra), under Section 138 N. I. Act, 1881 within time stipulated by this Court. It is submitted by learned counsel for the applicant that the aforesaid case is pending since 2017 and thus a suitable direction may be issued to the concerned Court to decide the same within specific time. No useful purpose would be served in keeping the application pending, which is finally disposed of with a direction to learned Additional Chief Judicial Magistrate, Auraiya to consider and decide the Complaint Case No. 975 of 2017 (Satya Narayan Dixit Vs. Manoj Kumar Mishra), under Section 138 N. I. Act, 1881 expeditiously, in accordance with law, without granting unnecessary adjournment to either of the party, provided there is no legal impediment.
