Judgment

Court No. - 44 Case :- CRIMINAL MISC. BAIL APPLICATION No. - 47856 of 2023 Applicant :- Dhirendra Singh Alias Sanju Tomar Opposite Party :- State of U.P. Counsel for Applicant :- Satyendra Narayan Singh,Pankaj Kumar Mishra Counsel for Opposite Party :- G.A. Hon'ble Pankaj Bhatia,J.

¶1Heard learned counsel for the applicant as well as learned A.G.A. and perused the record.

¶2The FIR in question was lodged alleging that the accused named in the FIR tried to cause harm and kill the applicant by the use of JCB, which was being driven by the driver.

¶3The applicant claims to be the owner of the JCB. On perusal of the medical on record, only simple injuries are revealed.

¶4Learned A.G.A. vehemently opposed the bail prayer.

¶5Considering the nature of injures suffered by the informant coupled with the fact that applicant is only driver of the JCB and not driving the JCB, applicant has no criminal history, there is nothing on record to demonstrate that the applicant if enlarged on bail, would in any way adversely affect the trial and without expressing any opinion on merit, I am of the view that the applicant is entitled to be released on bail.

¶6Accordingly, the bail application is allowed.

¶7Let the applicant Dhirendra Singh Alias Sanju Tomar be released on bail in FIR/ Case Crime No. 87 of 2023, under Sections 307, 427 IPC and 3/57 U.P. Sub Mineral (Concession) Rules, P.S.
