¶1Heard learned counsel for the petitioner and Ms. Pooja Agarwal, on behalf of the High Court, Allahabad.

¶2The basic relief sought by the petitioner in the present petition under Article 227 of the Constitution of India to direct the Addition Civil Judge (Junior Division) IInd, Ballia to decide the Misc Case No. 155 of 2023 (Sangeeta Gupta Vs. Parashuram Gupta and others), under Order 9 Rule 4 C.P.C.

¶3Pursuant to the order passed by this Court on 03.11.2023, a report has been submitted by the In-charge Civil Judge (Junior Division)-II, Ballia in which she has stated that on the recall application, notices were issued to the opposite parties on

02.05.2023. The court is vacant. The next date fixed in the matter for disposal of the application is 24.11.2023.

¶4In view of the matter, the writ petition is dispose of directing the court below before whom the matter is pending to decide the case expeditiously in accordance with law and without granting unnecessary adjournment unless there is no legal impediment.
