By means of the present application under Section 483 Cr.P.C., the applicant has sought for a suitable direction to the learned Judicial Magistrate-II, Gorakhpur to consider and decide Criminal Case No. 44190 of 2022 (State of U.P. Vs. Indrajeet Verma and others) arising out of Case Crime No. 84 of 2021 under Section 498A, 323 IPC and Section 3/4 Dowry Prohibition ACt, P.S. Khajani, District-Gorakhpur pending in the court of Judicial Magistrate-II, Gorakhur within time stipulated by this Court. It was submitted by learned counsel for the applicant that applicant has filed an F.I.R. on 27.03.2023 and Criminal Case No. 44190 of 2022 (State of U.P. Vs. Indrajeet Verma and others) arising out of Case Crime No. 84 of 2021 under Section 498A, 323 IPC and Section 3/4 Dowry Prohibition ACt, P.S. Khajani, District-Gorakhpur pending in the court of Judicial Magistrate-II, Gorakhur and but the same has not been decided so far due to which, applicant is suffering irreparable loss. Learned counsel further submits that a direction may be issued to the concerned Court to decide the same within specific time. No useful purpose would be served in keeping the application pending, which is finally disposed off with a direction to Judicial Magistrate-II, Gorakhur to consider and decide the aforesaid case expeditiously, in accordance with law as early as possible, provided there is no other legal impediment.
