¶2No one appears on behalf of the appellant to press this appeal. Sri Bade Lal Bind, learned counsel for the State is present, who has been heard.

¶3The present appeal has been filed by the appellant-Prem Raj, against the judgement and order dated 03.02.1995 passed by H.J.S. Badaun in Session Trial No. 245 of 1991, (State vs. Prem Raj), under Section 18/8 N.D.P.S. Act, P.S.- Binawar, District Badaun.

¶4As per office report dated 31.10.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 16.12.2021 informed that the appellant-Prem Raj has died. The said report has been sent after due enquiry.

¶5Accordingly, the appeal stands abated.
