¶2No one appears on behalf of the appellants to press this appeal. Sri Bade Lal Bind, learned counsel for the State is present, who has been heard.

¶3The present appeal has been filed by the appellants-Moti and Harpal, against the judgement and order dated 18.01.1995 passed by Special Judge Dacoity Affected Area, Badaun, in S.S.T. No. 57 of 1987 (State vs. Moti And Another) under Sections 392, 397 I.P.C., P.S.- Binawar, District Badaun.

¶4As per office report dated 31.10.2023 a report from C.J.M. concerned was called for regarding living status of the appellants in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 17.01.2022 informed that the appellants-Moti and Harpal have died. The said report has been sent after due enquiry.

¶5Accordingly, the appeal stands abated.
