¶2No one appears on behalf of the appellant to press this appeal. Sri Bade Lal Bind, learned counsel for the State is present, who has been heard.

¶3The present appeal has been filed by the appellant-Radhey Shyam, against the judgement and order dated 28.07.1995 passed by Sixth Upper Sessions Judge, Etah, in S.T. No. 43 of 1992 (State vs. Radhey Shyam) under Section 307 I.P.C., P.S.- Kotwali Dehat, District Etah.

¶4As per office report dated 31.10.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 23.07.2020 informed that the appellant-Radhey Shyam has died. The said report has been sent after due enquiry.

¶5Accordingly, the appeal stands abated.
