¶2No one appears on behalf of the appellant to press this appeal. Sri Bade Lal Bind, learned counsel for the State is present, who has been heard.

¶3The present appeal has been filed by the appellant-Sukhpal, against the judgement and order dated 16.12.2006 passed by Additional Sessions Judge, Court No. 5, Etah, in S.T. No. 308 of 2006 (State vs. Sukhpal) under Section 307 I.P.C., P.S.- Raja Ka Rampur, District Etah.

¶4As per office report dated 10.10.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 18.08.2023 informed that the appellant-Sukhpal has died. The said report has been sent after due enquiry.

¶5Accordingly, the appeal stands abated.
