¶2No one appears on behalf of the appellant to press this appeal. Sri Bade Lal Bind, learned counsel for the State is present, who has been heard.

¶3The present appeal has been filed by the appellant-Bodhan Loniha, against the judgement and order dated 23.03.2007 passed by Special Judge, SC/ST Act, Fatehpur, in S.S.T. No. 53 of 2001 (State vs. Bodhan Loniha) under Sections 323, 504, 506 IPC and Section 3(1)(X) SC/ST Act, P.S.- Khaga, District Fatehpur.

¶4As per office report dated 10.10.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 04.09.2023 informed that the appellant-Bodhan Loniha has died. The said report has been sent after due enquiry.

¶5Accordingly, the appeal stands abated.
