Judgment
Court No. - 35 Case :- WRIT - A No. - 18806 of 2023 Petitioner :- Anil Kumar Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Saurabh Sharma Counsel for Respondent :- CSC Hon'ble Vikas Budhwar,J. Heard Sri Saurabh Sharma, learned counsel for the writ petitioner and Sri Dhirendra Singh, learned Standing Counsel, who appears for Respondents 1 and 2. In view of the order, which is being proposed to be passed today, notices are not being issued to the third respondent. The writ petitioner claims to have been engaged as a 'Mali' since 2009 in the third respondent institution, Diwan Inter College, Hapur. According to him, his case is to be considered for regularisation as of now, despite the fact that he is to be regularised for the said post and the approval has been sought for making fresh solution/appointment. Prayer in the present petition is for a direction to the second and third respondent to regularise the writ petitioner. Learned Standing Counsel submits that the writ petitioner has not placed before this Court the document showing the nature of the appointment as well as the rules according to which he is to be regularised. Thus, the writ petitioner is not entitled for any relief. I have heard the learned counsel for the parties and perused the record carefully. Since in the writ petition, there is no document showing the nature of the appointment and the provisions, according to regularisation is to be made, thus, this Court does not find the present case to be a fit case for granting relief to the writ petitioner. Accordingly, the writ petition is consigned to record. The writ petitioner may approach the respondent for the grievances as and when he comes within the purview of the rules if so applicable in the case of the writ petitioner. Order Date :- 8.11.2023 A.
