He is a practicing advocate at Azamgarh. Learned counsel has further stated that a bare perusal of the statement of the victim recorded u/s 164 Cr.P.C. indicates that the applicant had facilitated her to meet her friend, Himanshu, to whom she is happily married. The only allegation against the applicant is that after sometime, he has colluded with her father and has not given her marriage certificate and other documents, as the victim had filed a petition before this High Court also. It is further stated that there is no allegation of assault or indecent behaviour against the applicant.

¶6Several other submissions have been made on behalf of the applicant to demonstrate the falsity of the allegations made against him. In case, the anticipatory bail application of the applicant is allowed, he will not misuse the liberty and shall cooperate with trial.

¶7On the other hand, learned A.G.A. has vehemently opposed the prayer for grant of anticipatory bail but unable to dispute the submissions raised by the learned counsel for the applicant and also the fact that the applicant has no criminal history.

¶8On due consideration to the arguments advanced by the learned counsel for the parties and in view of the law laid down by the Apex Court in the case of "Sushila Aggarwal Vs. State (NCT of Delhi)-2020 SCC online SC 98", the applicant is entitled to be granted anticipatory bail in this case.
