Heard learned counsel for the applicant and learned A.G.A. for the State of U.P. and perused the record. By means of this application, the applicant has prayed for expeditious disposal of Complaint Case No. 638 of 2022 (Priyanka Singh vs. Sunil Singh and others) under Section 12 of Domestic Violence Act, Police Station Patherva, Kushinagar pending in the court of Judicial Magistrate, Kasya, Kushinagar within a time bound frame. It is submitted by learned counsel for the applicant that the aforesaid case under Section 12 of Domestic Violence Act filed by the applicant on 18.05.2022 is still pending before the concerned court below. In the said case, opposite party no. 2 has filed his objection but the same is being lingered on by the opposite parties adopting different modus-operandi. Learned A.G.A. states that no useful purpose would be served in issuing notice to opposite parties and keeping this application pending before this Court and it may be disposed of at this stage itself. Considering the limited grievance of the learned counsel for the applicant, learned court below is directed to make an endeavour to decide the aforesaid case, as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is produced before it, if there is no legal impediment.
