The dispute in the present petition is regarding devolution of the property of Malti Devi who is the mother of the petitioner. The petitioner claims devolution on the basis of succession. Certain other persons claim right to the property on the basis of a registered Will executed in their favour by the deceased mother of the petitioner. The dispute involves title and, therefore, the petitioner has the remedy to institute appropriate proceedings for declaration of her rights and writ proceedings are not the appropriate remedy.
