¶1Heard learned counsel for the petitioner, Mr. Abhinav Ojha, learned Standing Counsel for the State-respondents and Mr. Sudhir Bharti, learned counsel for the respondent-Gaon Sabha.

¶2The instant petition has been filed for mandamus directing the respondent no.1 i.e. Commissioner, Gorakhpur Mandal, Gorakhpur to expedite the proceeding of Case No.4 of 2013-14 (Computer Case No.C20130500001556) (Ramswarath vs. Kalika Urf Kali), under Section 219 of U.P. Land Revenue Act, 1901 within stipulated period.

¶3Learned counsel for the petitioner submitted that the aforementioned revision filed on behalf of the petitioner is pending before respondent no.1 since 2013. He further submitted that certified copy of the order sheet of the case has been annexed as Annexure No.2 to the petition in order to demonstrate that the case is not proceeding expeditiously.

¶4Without expressing any opinion on merits of the case and keeping in view of the facts and circumstances, respondent no.1 is directed to decide the aforementioned case on merits after giving an opportunity of hearing to the parties in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order before him.
