Judgment

Court No. - 6 Case :- WRIT - C No. - 35723 of 2023 Petitioner :- Vijay Prakash Sharma Respondent :- State of U.P. and Another Counsel for Petitioner :- Karunesh Narayan Tripathi Counsel for Respondent :- C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Karunesh Narayan Tripathi, learned counsel for the petitioner and learned Standing Counsel for the State-respondent. The writ petition has been filed with the prayer to direct the respondent no.2 to decide the arms license application of the petitioner, by granting arms license of rifle to the petitioner, pending before him, within stipulated period. Learned counsel for the petitioner submits that for safety and security of the family members the arms license is required. In this regard, an application has been moved before respondent no.2, which is pending since 2019, therefore, a direction may be issued to authorities concerned to take decision on the application of the petitioner, as soon as possible. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Considering the facts and circumstance of the case, without expressing any opinion on the merits of the case, this writ petition is finally disposed off with a direction to the respondent no.2 i.e. District Magistrate, Bareilly to decide the application of the petitioner, which is pending since 2019, in accordance with law, after giving opportunities of hearing to the petitioner, by means of a reasoned and speaking order, as expeditiously as possible, from the date of production of a certified copy of this order, if there is no legal impediment.
