¶2No one appears on behalf of the appellant to press this appeal. Sri Bade Lal Bind, learned counsel for the State is present, who has been heard.

¶3The present appeal has been filed by the appellant-Chittu @ Chitranjan, against the judgement and order dated 20.11.2006 passed by Additional Sessions Judge-Vith, Pilibhit, in S.T. No. 303 of 1998 (State of U.P. Vs. Sunil Rai and Others) and also in S.T. No. 303-A of 1998 (State of U.P. Vs. Anand Sarkar and Others), under Sections 147, 395, 332 read with section 149 and 225 I.P.C., P.S.- Madho Tanda, District Pilibhit.

¶4As per office report dated 12.10.2023 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 04.09.2023 informed that the appellant-Chittu @ Chitranjan has died. The said report has been sent after due enquiry.

¶5Accordingly, the appeal stands abated.
