¶1Heard Mr. Sunil Kumar Pandey, learned counsel for the petitioner, learned standing counsel for the state and Shadab Husain, Advocate holding brief of learned counsel for the respondent.

¶2Petitioner has assailed the demolition order dated 28.9.2023.

¶3At the outset, objection has been raised to the maintainability of the present petition.

¶4Objection is sustained. Accordingly, the writ petition is disposed of with the direction subject to petitioner filing a statutory appeal within a period of three weeks from today, the same may be entertained, heard and decided on merits without raising any objection as to the limitation after hearing all necessary parties, as expeditiously as possible preferably within a period of one month from the date of first compliance of this order.
