The Investigating Officer recorded the statement of complainant, her husband and some other witnesses, wherein it has been stated that they found dead body of the deceased on the railway line. Learned counsel for the applicant further submits that there is allegation that deceased went with the applicant and other co-accused, Jaypal, but there is no evidence against the applicant except his judicial confession before one witness, namely, Nitesh, wherein he admitted that he pushed the deceased before the running goods train, thus, applicant has falsely been implicated in the present case.
