¶1Heard learned Counsel for the parties and perused the record.

¶2The present petition has been filed for the following relief: "I. Issue a writ, order or direction in the nature of mandamus commanding the Additional Commissioner (Judicial) Ist, Agra Division, Agra to decide the appeal no.1423 of 2022 (Computerized Case No.C202201000001423) (Radhakishan Vs. Tej Singh and others) under Section 24 (4) of the U.P. Revenue Code."

¶3Against an order dated 12.9.2022 passed in Case No.973 of 2022 (Radhakishan Vs. Tej Singh and others) in proceedings under Section 24 of the U.P. Revenue Code, 2006, an appeal has been filed by the respondent no.3, which is pending since then.

¶4No useful purpose would be served in keeping this petition pending.

¶5Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to the respondent No.2, Additional Commissioner (Judicial) Ist, Agra Division, Agra to consider and decide the aforementioned appeal in accordance with law within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
