¶1Heard Sri Mahendra Singh, learned counsel for the petitioners, learned Standing Counsel for State-respondents and perused the record.

¶2The petitioners' claim for its inclusion in grant-in-aid list of the State Government is pending consideration before respondent no.1, in terms of application dated 24.8.2023, said to have been dispatched through registered post.

¶3Learned Standing Counsel submits that such matters require submission of reports from respondent no.1 - State of U.P. through its Secretary (Minority Welfare Department) Government of U.P. at Lucknow, respondent no.2 - Director Minority Welfare Department, U.P. at Lucknow, respondent no.3 - District Magistrate, District Kushinagar and respondent no.4 - District Minority Welfare Officer, District Kushingar, after due verification and, therefore, consideration of the petitioners' claim in accordance with law will consume some time.

¶4The writ petition is disposed of directing respondent no.2 - Director Minority Welfare Department, U.P. at Lucknow, respondent no.3 - District Magistrate, District Kushinagar and respondent no.4 - District Minority Welfare Officer, District Kushingar to consider the petitioners' applications moved before them and after due verification and inspection activity, they shall submit report before the State Government by the end of February, 2024 and, thereafter, the State Government shall take decision before 31.5.2024, provided a certified copy of this order is filed before respondent no.2 and photo-copies of the same before respondent nos. 3 and 4 by the end of this month.

¶5It is made clear that this Court has not adjudicated upon merits of the petitioners' claim and the concerned respondents shall submit the reports and take a decision in the matter strictly in accordance with the government policy. Order Date :- 9.11.2023 CS/- High Court of Judicature at Allahabad
