The present second bail application has been filed by the applicant in Case Crime No.0056 of 2022, under Section 302 I.P.C., Police Station - Nawabad, District - Jhansi, with the prayer to enlarge him on bail during the pendency of trial. First bail application in the present case was rejected on

11.11.2022 with a direction to conclude the trial within a year. Second bail application is being filed stating that out of twenty two witnesses, only thirteen have been examined and the prosecution has also moved an application, under Section 311 Cr.P.C. for recall of eight other witnesses. It is also submitted that the star witness of the prosecution namely; Ravi Dinkar, who has been examined as P.W.-3, has also turned hostile and it is also submitted that there is no other eye-witness account of the incident. Considering the facts and circumstances of the case as well as submissions made by learned counsel for the parties and perusing the material brought on record and that the trial is also likely to take sufficiently long, without expressing any opinion on merits of the case, the applicant is held entitled to grant of bail. However, any observation made hereinabove, will not affect the trial of the case.
