1.Heard Counsel for the petitioner, Mr. Om Prakash Sharma, learned Additional Chief Standing Counsel for the State-respondents, Mr. Sanjay Kumar Om, learned counsel for respondent No.5 and Mr. Sudhir Bharti, learned counsel for Land Management Committee.

2.The instant writ petition has been filed praying for a mandamus commanding the respondents to construct the separate water tank for Gram Sabha-Village-Kuwabar, Kshetra Panchayat-Pali, Tehsil-Sahjanwa, Disrict-Gorakhpur and also to repair/ construct the same in public interest.

¶3Mr. Sanjay Kumar Om, learned counsel for respondent No.5 has already placed the instruction dated 26.07.2023 before the Court, which is on record.

¶4Mr. Sanjai Kumar Om, learned counsel for respondent No.5 on the basis of the instruction dated 26.07.2023 sunbmitted that under the Government Scheme, the proposal has been made for constructing the water tank in Gram Panchayat-Punda and construction is going on but petitioner is making hindrance. It is also submitted that by constructing the water tank in Gram Panchayat-Punda, the villagers of both Gram Panchayat-Kuwabar as well as Punda will be benefited. He further placed the government order dated 05.10.2021 in which scheme has been set up for constructing the water tank in Gram Panchayat and according to the government order the proposal has been made and the place has been inspected for constructing the water tank in Gram Panchayat-Punda.

5.Learned counsel for the petitioner submitted that petitioner is not opposing the construction of water tank in Gram Panchayat-Punda rather the villagers of Gram Panchayat-Kuwabar are also pressing for construction of water tank in their village/ Gram Panchayat-Kuwabar also come under the criteria for construction of water tank. He further submitted that villagers of Gram Panchayat-Kuwabar have represented the authorities for construction water tank in Gram Panachayat-Kuwabar, but authorities are not considering the demand of the villagers of Gram Panchayat-Kuwabar. Hence this Public Interest Litigation for the mandamus directing the authorities to take steps for construction of water tank in Gram Panchayat-Kuwabar.

¶6I have considered the arguments advanced by the counsel for the parries and perused the record.

7.In order to appreciate the controversy, the instruction dated 26.07.2023 submitted by Executive Engineer U.P. Jal Nigam,(Gramin) Gorakhpur is relevant, which is as under: "

¶8Perusal of the instruction as well as Government Order dated 05.10.2021 annexed along with the instruction demonstrate that authorities are proceeding according to the government order for construction of water tank in Gram Panchayat-Punda. So far as request of the petitioner of the instant public Interest Litigation is concerned, the same cannot be examined by this court by way of instant P.I.L., as such no interference is required in exercise of jurisdiction under Article 226 of the Constitution of India and Public Interest Litigation (P.I.L.) is dismissed.
