¶1The instant petition has been filed praying for a writ of mandamus restraining respondent no.3 i.e. Executive Engineer, Public Works Department, Fatehpur from constructing road on the bhumidhari land of the petitioners situated in Village Dendasai, Pargana Ekdala, Tehsil Khaga, District Fatehpur without paying compensation to them.

¶2The instructions furnished by respondent no.3 is placed on record by Sri Rajeev Gupta, learned Additional Chief Standing Counsel, according to which, there is financial sanction for repair of existing CC road, width of which is stated to be 3 meters. It is also specifically stated in the instructions that the houses of the petitioners would not be affected thereby.

¶3In view of the aforesaid stand of the State respondents, we are of the opinion that no further direction is required to be issued.
