¶22From perusal of the interim order dated 23.11.2004 passed in Writ Petition No.49491 of 2004, no case for contempt is made out as the writ Court has only stayed the proceedings in Second Appeal No.17 of 1985-86, which was pending before Board of Revenue. There is no averment in the contempt petition as to the fact that the second appeal has been decided or the Board of Revenue is proceeding with the matter. The contempt application is misconceived.
