Learned Standing Counsel for the State-respondent does not have any objection in case a fresh recall application is moved and direction is given to decide the same within stipulated period. Considering the facts and circumstance of the case, it is provided that the petitioner shall file a fresh recall application, ventilating all his grievances, before the competent authority, within three weeks from today along with a certified copy of this order. In case, such a recall application is being moved, the competent authority shall make all endeavours to consider and decide the same, in accordance with law, by means of a reasoned and speaking order, preferably within a period of one month, from the date of production of certified copy of this order, if there is no legal impediment. Till two months, no coercive action pursuant to the ex-parte order dated 23.09.2022 shall be taken against the petitioner. With the aforesaid observations, the writ petition is disposed off.
