Judgment

Court No. - 1 Case :- MATTERS UNDER ARTICLE 227 No. - 8871 of 2023 Petitioner :- Rajmuni Singh Respondent :- Sanjay Kumar Singh Counsel for Petitioner :- Prashant Pandey Hon'ble Jayant Banerji,J. Heard learned counsel for the petitioner. This petition has been filed seeking following relief: "1. Issue an order or direction to the court of Civil Judge (Senior Division), Chandauli to decide the Temporary Injunction Application Paper No. 6C filed along with Suit No. 565 of 2022 (CNR No. UPCD050035342022) (Rajmuni Singh Vs. Sanjay Kumar Singh) pending before him within stipulated period or time as fixed by this Hon'ble High Court." It appears that the plaintiff-petitioner filed a suit seeking permanent injunction with regard to suit property that appears to be undefined and is agricultural land. It is stated that the suit was filed on 15.09.2022. Notices were directed to be issued on the application 6-C, which was filed seeking temporary injunction. It is prayed by the learned counsel for the petitioner that the application 6-C may be directed to be decided. Under the circumstances, without expressing any opinion on maintainability or merit of the application and suit, this petition is disposed of with the direction to the Civil Judge (Senior Division), Chandauli to endeavour to dispose of the application 6-C filed by the plaintiff-petitioner in Original Suit No. 565 of 2022 without granting any unnecessary adjournments to either of the parties, provided the defendants are duly served and they are afforded due opportunity of hearing, and there is no legal impediment.
