Judgment
Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 6209 of 2017 Applicant :- Narendra Singh Opposite Party :- Gurdeep Singh And Another Counsel for Applicant :- Anand Prakash Srivastava Hon'ble Rohit Ranjan Agarwal,J. List has been revised. No one is present on behalf of applicant to press the application. The appellate Court on 24.08.2016 in Second Appeal No. 705 of 2015 had passed the following order:- "Vakalatnama filed on behalf of respondent no.1 is taken on record. Heard learned counsel for the respondents of the stay vacation order. Appellants' counsel is not present even in the revised call. Learned counsel for the respondents submitted that the appellant is misusing the order passed by this Court on 4.8.2015. So far as the order dated 4.8.2015 is concerned, there is no observation regarding the question of possession of either party over the disputed land. Interim order is only to this effect that both the parties are hereby directed not to create third party right or alienate or change the nature of the suit property. Hence, it is clarified that this Court has not observed anything in the order dated 4.8.2015 that either of the party is in possession. Stay vacation application is, accordingly, disposed of. List this appeal for hearing in the usual course of time." From perusal of the interim order passed by appellate Court as well as supplementary affidavit filed by the applicant, no case for contempt is made out. The contempt application is misconceived and stands dismissed. Order Date :- 16.11.2023 V.S.Singh High Court of Judicature at Allahabad
