¶1Supplementary affidavit filed on behalf of the petitioner is taken on record.

¶2Heard Counsel for the petitioner and learned Standing Counsel for State-respondents.

¶3The instant writ petition has been filed praying for a mandamus directing respondent No.4, Tehsildar, Tehsil Bisuali, District Badaun to decide the case No. 5969 of 2023, Computerized case No. T202312070205969 (Udayveer Vs. Prem Raj) under Section 34 of U.P. Revenue Code, 2006 within stipulated period.

¶4Counsel for the petitioner submitted that the aforesaid mutation case is pending before respondent no.2 for adjudication. He further submitted that objection has been filed in the pending proceeding but Court is not proceeding according to the provisions contained under Rule 34 (7) of U.P. Revenue Code, Rules 2016.

¶5Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No.4, Tehsildar, Tehsil Bisuali, District Badaun to consider and decide the aforementioned mutation case in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
