¶1Sri Sunil Kumar Singh, counsel for the petitioner, is present.

¶2The grievance of the petitioner in the present petition is that the respondent nos. 3 to 10 have illegally encroached over the pathway used for the ingress and egress of the petitioner.

¶3The petition involves disputed questions of fact which can only be decided on evidence and, therefore, writ proceedings are not the appropriate remedy for the relief prayed by the petitioner. The petitioner has the remedy to institute appropriate proceedings before the civil court.
