Judgment

Court No. - 40 Case :- WRIT - C No. - 35711 of 2023 Petitioner :- Smt. Guddo Devi Kushwaha Respondent :- The State Of U.P. And 3 Others Counsel for Petitioner :- Ram Bahadur Counsel for Respondent :- C.S.C Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J.

¶1Heard learned counsel for the petitioner and Shri Ambrish Shukla, learned Additional Chief Standing Counsel for the State respondents.

¶2Petitioner is Ex-Pradhan of Village Niwada, Block Muskara, Tehsil Maudaha, District Hamirpur. It is claimed that petitioner was appointed as 'Receiver' in the proceeding under Section 145(1)/145(8) IPC, which is pending consideration before the Additional District Judge, F.T.C.I., Hamirpur and certain food items were put in her residence in response to the order dated

28.04.2020. It is complaint to us that inspite of repeated request till date the respondents have not lifted the food items, which are lying at her place and as such, it is prayed to command the respondents to look into the matter and take appropriate action.

¶3In the facts and circumstances, no useful purpose would be served in keeping the writ petition pending consideration. The writ petition is disposed of asking the petitioner to move an appropriate application before the Sub Divisional Magistrate concerned ventilating all her grievance. In case any such application is moved within a week's time, the Competent Authority would look into the matter and take appropriate decision in further week's time. Needless to say that we have not adverted on the merits of the case. Order Date :- 16.11.2023 A. Pandey High Court of Judicature at Allahabad
