¶1Heard learned counsel for the applicant and learned AGA for State.

¶2Learned AGA has raised preliminary objection and submitted that this application is not maintainable as against the order impugned, applicant has alternative remedy to file revision under Sections 397/401 Cr.P.C.

¶3Learned counsel for the applicant could not dispute the aforesaid fact.

¶4The application is dismissed with liberty to the applicant to approach competent court, if so advised.

¶5In case, any revision is filed within 15 days from today, same shall not be rejected on ground of laches, but be decided on merits.

¶6Certified copy of the order be returned to learned counsel for the applicant after keeping the photocopy Order Date :- 16.11.2023 Amit/- High Court of Judicature at Allahabad
