This criminal revision has been filed by the revisionist against the impugned order dated 27.07.2023 passed by Special Judge (E.C. Act), Aligarh in Criminal Revision No. 257 of 2023 by which the lower Revisional Court had stayed the order passed by trial court dated 24.07.2023 in Case No.- 172 of 2023. Learned A.G.A. has raised preliminary objection that the revision preferred by revisionist before the court below is still pending for consideration and the present revision has been filed against the stay order which is interlocutory in nature and the present criminal revision preferred by revisionist is not maintainable. Considering the facts and circumstances of the case and without going into the merits of the case, the lower Revisional Court/Special Judge (E.C. Act), Aligarh is directed to expedite the proceedings and decide the Criminal Revision No. 257 of 2023 expeditiously preferably within a period of one month from the date of production of certified copy of this order after affording opportunity of hearing to the parties concerned, unless there is any legal impediments.
