Heard Mr. Anil Kumar Srivastava, learned counsel for the petitioner and perused the record. The writ petition has been filed by the petitioner with a prayer to direct the Motor Accident Claim Tribunal/District Judge, Kanpur Nagar to decide Claim Petition No.160 of 2018 (Nawal Kishor Gupta vs. Sajeevan Lal Vishwakarma and others) within the period specified by the Court. Learned counsel for the petitioner submits that the petitioner met with a road accident, due to which he suffered physical disability. Aggrieved by the same, he filed a claim petition before the Motor Accident Claim Tribunal which is pending since 2018, therefore, a direction may be issued to authorities concerned to decide the claim petition, as expeditiously as possible. Learned Standing Counsel has no objection to the same. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Considering the facts and circumstance of the case and without expressing any opinion on the merits of the case, this writ petition is finally disposed off with a direction to the authorities concerned to decide the claim petition of the petitioner, and pass appropriate order, in accordance with law, by means of a reasoned and speaking order, after giving opportunities of hearing to the parties concerned, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of six months, from the date of production of certified copy of this order, if there is no legal impediment.
