¶1The instant petition has been filed praying for a writ of mandamus commanding the respondents to compute and pay a sum of Rs. 12,07,680/- as compensation to the petitioners in lieu of acquisition of their bhumidhari plot no. 65sa, Village Jekhauta, Tappa Sirsi, Pargana Mahuli Purab, Post Ghorang, District Sant Kabir Nagar.

¶2Learned counsel for respondent no. 3 on instructions states that award has already been declared. In support of his contention, he has annexed a Communication dated 23.9.2023 by Competent Authority, addressed to the Executive Engineer, PWD, Basti, requiring him to arrange money for payment of compensation to the tenure holders in accordance with the award. At Sl No. 10 of the tabular chart, is Village Jekhauta, in respect of which the instant petition has been filed.

¶3Learned counsel for the petitioners states that the petitioners would approach the Competent Authority for withdrawal of the compensation amount and they also reserve their right to challenge the award.

¶4Accordingly, the petition is disposed of with liberty to the petitioners to withdraw the compensation amount and also challenge the award in appropriate proceedings if they feel aggrieved thereby.
