¶1The petitioner have preferred the present petition with the following prayer:-

¶1set aside the order dated 17-10-2023 passed by A.D.J. Court No.1 Farrukhabad passed in Misc. Appeal No. 03 of 2023 and further also set aside the order dated 4-2-2023 passed by Civil Judge (J.D.) Court No.5 Farrukhabad passed in original suit No. 545 of 2004 (Pitambbar Das vs. Pratap Singh and another) in 6c Application.

¶2After some arguments, learned counsel for the petitioner confined his prayer only to the effect to direct the Court below or before whom the mater is pending to decide the Original Suit No.545 of 2004 (New No.520 of 2022) (Pitambar Das Vs. Pratap Singh and another) expeditiously.

¶3It reveals from perusal of the record that the suit is pending more than 19 years and considerable time has already been lapsed but till date the same is still pending.

¶4In the facts and circumstances of the case and without interfering with the order dated 17-10-2023 passed by A.D.J. Court No.1 Farrukhabad passed in Misc. Appeal No. 03 of 2023 and further also set aside the order dated 4-2-2023 passed by Civil Judge (J.D.) Court No.5 Farrukhabad passed in original suit No. 545 of 2004 (Pitambbar Das vs. Pratap Singh and another) in 6c Application, the present petition is disposed of directing the Court below to decide the aforesaid suit most expeditiously but without granting any unnecessary adjournment, if there is no legal impediment.
