¶1Heard Sri Vishesh Rajvanshi, learned counsel for the petitioner, learned Standing Counsel for both the respondents and perused the record.

¶2The petitioner passed High Schools Examination in 2017 and Intermediate Examination in 2019 and is aggrieved by his incorrect name in the marks-sheets as well as incorrect date of birth recorded therein.

¶3It is contended that the petitioner's application dated 27.07.2023 along with necessary documents is pending consideration before the respondent no.2 (Additional Secretary, Board of High School and Intermediate Education, District Prayagraj).

¶4Learned Standing Counsel submits that such requests can be entertained strictly in accordance with law in the light of Regulations framed under the U.P. Intermediate Education Act, 1921.

¶5The writ petition is disposed of in the following terms:-

(i) The petitioner is permitted to file a certified copy of this order along with fresh application annexing therewith a copy of the previously moved application and enclosures thereto before the respondent no.2 (Additional Secretary, Board of High School and Intermediate Education, District Prayagraj) within a period of three weeks from today.

(ii) The respondent no.2 (Additional Secretary, Board of High School and Intermediate Education, District Prayagraj) shall take a decision on the petitioner's application strictly in accordance with law after verifying the necessary documents by the end of February, 2024 and shall communicate the decision to the petitioner by registered post.

¶6It is made clear that this Court has not examined the petitioner's claim on merits and it is for the respondent no.2 (Additional Secretary, Board of High School and Intermediate Education, District Prayagraj) to examine the same strictly in accordance with law, particularly Regulations contained under Chapter 3 of U.P.
