Kajal Singh And 6 Others Respondent :- Presiding Officer, Motor Accident Claim Tribunal (South) And 3 Others Counsel for Petitioner :- Shreesh Srivastava Hon'ble Mrs. Manju Rani Chauhan,J. Heard Mr. Shreesh Srivastava, learned counsel for the petitioner and perused the record. The writ petition has been filed by the petitioner with prayer to direct the Learned Presiding Officer, Motor Accident Claim Tribunal (South), Kanpur Nagar to decide the M.A.C.P. Case No.727 of 2018 (Smt. Kajal Singh and other versus TATA AIG General Insurance Company Limited and others) pending before him, within the time specified by this Hon'ble Court. Learned counsel for the petitioner submits that the husband of petitioner no.1 died in a road accident on 21.06.2018 due to which a claim petition was filed before Motor Accident Claims Tribunal/District Judge, Kanpur Nagar in the year 2018 which is still pending, therefore, a direction may be issued to respondent no.1-Presiding Officer, Motor Accident Claim Tribunal (South), Kanpur Nagar to decide the same, as expeditiously as possible. Learned Standing Counsel has no objection to the same. No useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Considering the facts and circumstance of the case and without expressing any opinion on the merits of the case, this writ petition is finally disposed off with a direction to the respondent no.1-Presiding Officer, Motor Accident Claim Tribunal (South), Kanpur Nagar to decide the claim petition of the petitioner, and pass appropriate order, by means of a reasoned and speaking order, in accordance with law, after giving opportunities of hearing to the parties concerned, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within a period of six months, from the date of production of certified copy of this order, if there is no legal impediment.
