Judgment
Court No. - 10 Case :- WRIT - C No. - 30343 of 2023 Petitioner :- Anil Kumar Kamiya Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Vishal Agarwal Counsel for Respondent :- CSC,Rohan Gupta,Rohit Pandey Hon'ble Kshitij Shailendra,J.
¶1Heard Sri Vishal Agarwal, learned counsel for the petitioner, learned Standing Counsel for the respondent no.1, Sri Rohit Pandey for the respondents no.2 and 3 and Sri Harshit Gupta, holding brief of Sri Rohan Gupta, for the respondent no.4.
¶2The case of the petitioner is that though he rightfully and lawfully completed LL.B course in 1999 and thereafter got himself registered with the Bar Council of Delhi, by the order impugned dated 22.06.2023, the respondent University has observed that the marks-sheets of the petitioner were completely forged and not issued from University.
¶3Sri Rohit Pandey, learned counsel for the University, submits that the petitioner's result was shown as incomplete, vide Annexure No.4 to the writ petition. He has come up with the instructions that now the University has issued a fresh marks-sheet to the petitioner.
¶4In view of the above, the Court finds that the impugned order has lost its significance, however, the submission of Sri Vishal Agarwal is that since Bar Council of Delhi has debarred the petitioner from practising on the communication issued by the University, the petitioner is still out of practice.
¶5The Bar Council of Delhi, not being party to the writ petition nor its order of debarring the petitioner being under challenge, it is open for the petitioner to approach the Bar Council of Delhi along with copy of fresh marks-sheet issued by Bundelkhand University, Jhansi.
¶6As soon as the petitioner approaches the Bar Council of Delhi, it shall consider the petitioner's grievance in accordance with law and shall pass appropriate orders by the end of January, 2024 [Directions issued in terms of Article 226(2) of the Constitution of India].
¶7The petitioner may also approach the Bar Council of India, i.e. the respondent no.4 with necessary application and certified copy of this order and it is excepted that the Bar Council of India shall also communicate the Bar Council of Delhi about compliance of this order.
¶8The writ petition is, accordingly, disposed of. Order Date :- 17.11.2023 AKShukla/- High Court of Judicature at Allahabad
