¶1After some arguments, Sri Ritukar Gupta, learned counsel for the petitioner confined his prayer to the effect to direct the Court below namely Civil Judge (Junior Division) Iglas District Aligarh to pass appropriate orders on the application dated 21.10.2022 filed by the petitioner which was registered as Misc. Case No.35 of 2022. The aforesaid application has been filed in the Execution Case No.2 of 2018. Learned counsel for the petitioner prayed that the Court below be directed not to proceed in the Execution Case before passing appropriate orders on the aforesaid application being Misc. Case No.35 of 2022.

¶2Heard learned counsel for the petitioner and perused the record.

¶3In the facts and circumstances of the case and without entering into merits of the case, the present petition is disposed of directing the Court below namely Civil Judge (Junior Division) Iglas District Aligarh first of all take a decision on Misc. Case No.35 of 2022 filed in Execution Case No.2 of 2018 and only thereafter proceed with the execution case. Order Date :- 17.11.2023 saqlain High Court of Judicature at Allahabad
