¶1Heard learned counsel for the parties and perused the record.

¶2Petitioner has filed this writ petition seeking a direction to respondent no. 2 to decide Case No. 174/105/148/2013-2014 (Smt. Katra Vs. Sonbarsi and others).

¶3Pursuant to earlier order, learned Standing counsel has received instructions, which is taken on record.

¶4On the basis of the instructions received, learned Standing Counsel submits that the aforesaid case was decided as abated vide order dated 05.05.2000. After the restoration of the case, vide order dated 16.09.2003 the case was dismissed. The petitioner being aggrieved filed appeal wherein vide order dated 20.10.2016 the matter has been remanded to the Court of Addl. District Magistrate with a direction to decide the case on merits after hearing respective parties. In pursuance of the appellate order, matter is pending before respondent no. 2 and the next date is fixed as 29.11.2023.
