¶1Heard Shri Suresh Pratap Singh, learned counsel for the petitioner and Shri Vibhav Ojha, learned AGA appearing for the State respondents.

¶2Present petition has been filed seeking quashing of the impugned first information report dated 11.10.2023, registered as case crime no.0190 of 2023, under Section 376(2)(n), 313, 406 IPC, Police Station Duboliya, District Basti. Further prayer has been made not to arrest the petitioner pursuant to said FIR.

¶3After some arguments, learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to avail the remedy as may be available to the petitioner in accordance with law.

¶4Prayer aforesaid is allowed.
