Judgment

Court No. - 9 Case :- CONTEMPT APPLICATION (CIVIL) No. - 2161 of 2022 Applicant :- Dr. Devendra Kumar Singh Opposite Party :- Shri Amit Mohan Prasad,Addi. Chief Secretary And Another Counsel for Applicant :- Chandrakesh Rai,Tej Bahadur Rai Hon'ble Rohit Ranjan Agarwal,J. The writ Court on 21.10.2021, while disposing of Writ-A No.13879 of 2021, had passed the following order:- "Petitioner's claim for grant of promotional pay scale under ACP scheme has already been forwarded by Chief Medical Officer, Jaunpur, on

04.03.2020 to the second respondent but despite lapse of sufficient time no decision has been taken and hence this petition. Learned Standing Counsel states that an appropriate decision would be taken by the competent authority, expeditiously. Petitioner's claim appears to be pending for long. There is no reason why such claims are not dealt with, expeditiously. A writ of mandamus is thus issued to second respondent to take an appropriate decision upon the recommendation made by Chief Medical Officer, Jaunpur, on 04.03.2020 in respect of grant of promotional pay scale under ACP scheme within a period of four months from the date of presentation of a copy of this order. It goes without saying that all consequential benefits would be extended to petitioner without any further loss of time. Writ petition is, accordingly, disposed of. " Today when the case was taken up, learned Standing Counsel has placed the instructions so received by him, which are taken on record. According to learned Standing Counsel, the claim of the applicant has been decided and the order of the writ Court has been complied with by the opposite party. In view of the said fact as the order of the writ Court has been complied with and the claim of the applicant has been decided, present contempt application is rendered infructuous and the same stands dismissed. However, it is open to the applicant to assail the order passed by the opposite party before appropriate forum, if so advised.
