Judgment
Court No. - 82 Case :- HABEAS CORPUS WRIT PETITION No. - 629 of 2023 Petitioner :- Dharampal And 2 Others Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Rohit Kumar Singh Counsel for Respondent :- G.A. Hon'ble Shree Prakash Singh,J. Heard learned counsel for the petitioners and learned A.G.A. for the State. In compliance of the order of this Court dated 10.10.2023, petitioner no. 2 Babita Mishra (corpus) has been produced before this Court. Petitioners have been identified by their counsel and they also put their signatures on the order sheet. On query being asked, she replied that she is 27 years of age and she is legally wedded wife of Sudhakar but now she is willing to go with Dharmpal, i.e. petitioner no. 1. Once the alleged detenue has accepted that she is legally wedded wife of Sudhakar, then it cannot be said that she was unlawfully been detained by Sudhakar. In this view of the matter, the personal appearance of petitioner no. 2, Babita Mishra (corpus) is hereby exempted. The detenue Babita Mishra is major and thus she may go on her place of choice with her own sweet will. In view of the above, the writ petition stands disposed of. The matter is consigned to record.
