Hon'ble Mrs. Manju Rani Chauhan,J. Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondent. This writ petition has been filed to direct the respondent no. 2 to constitute a committee of higher officer to conduct an inquiry on the complaint made by Sanoj Kumar as both the report submitted by the Additional Magistrate (Admin.) Etha and Khand Vikas Adhikari Jaithra, Etha are contradictory and further direct to respondent no. 2 to decide the representation of the petitioner dated 14.06.2023 pending before him within stipulated period. It has been stated by the learned counsel for the petitioner that the petitioner is a fair price shop dealer of village Panchayat Nakhatpura, Vikas Khand Jaithra, Tehsil Aliganj, District Etah. It appears that on some complaint made by one Sanoj Kumar inquiries were conducted twice. In the earlier inquiry as conducted by a team of Additional District Magistrate, the petitioner was found guilty whereas in the other inquiry as conducted by comprising three members charges as levelled against the petitioner have not been found to be correct. The representation to get the inquiry conducted by higher officials and revision in this regard has not been decided. The learned Standing Counsel submits that the writ petition is premature as no order has been passed against the petitioner. In view of the above this petition is accordingly, dismissed. There shall be no order as to costs. Order Date :- 16.11.2023 Arti High Court of Judicature at Allahabad
