¶1Heard learned counsel for the parties.

¶2Petitioner has prayed for following reliefs as substantial relief: "(i) Issue a writ, order or direction in the nature of mandamus commanding the respondent No.5/ Deputy Directory of Agriculture, Chandauli to ensure and release Rs.50,000/- of the gratuity, pension, leave encashment as well as amount of rashikaran in favour of the petitioner forthwith."

¶3Learned Standing Counsel has drawn attention of the Court towards the order dated 04.10.2023 which has been annexed as Anneuxre-23 to the writ petition, according to which, entire dues have been directed to be paid except Rs.50,000/- which has been withheld. He further submits that as per instructions obtained by him, the entire payment has come to be made on 04.11.2023 by transmitting the amount into the account of petitioner.

¶4Since the petitioner has not challenged the order dated

04.10.2023, no effective relief now can be granted. Accordingly, liberty rests with the petitioner to apply against the order dated

04.10.2023 to the extent it withholds Rs.50,000/-.

¶5Subject to the aforesaid liberty, this petition is consigned to record.
