Petitioner is aggrieved by a notice issued by Nagar Panchayat, Bharat Bhari District-Siddharth Nagar, which records that petitioner is raising construction of a house on a public road belonging to the Local Authority. Grievance of the petitioner is that although a reply has been submitted in the matter, pointing out that construction is on the petitioner's plot, yet a final decision is not being taken. Sri Rajesh Kumar Chitragupta, appearing for respondent no.3 states that grievance of the petitioner would be examined by passing reasoned order in the matter. In the facts of the case, it appears that there is essentially an issue of demarcation of plot, which can be attended to, by the competent authorities of State at the first instance. The petitioner can either approach the competent forum for demarcation of his land or else his objection in the matter shall be dealt with by the 3rd respondent, by passing a reasoned order, within a period of four weeks from the date of presentation of a certified copy of this order.
