¶1Learned counsel for the petitioner is present.

¶2As per the office report dated 20.11.2023, the report from the District Judge, Varanasi has been placed on record. The report of the District Judge, Varanasi, dated 18.11.2023 as well as the report of the In-charge Additional Civil Judge (Junior Division), court No.6, Varanasi, dated 18.11.2023 have been perused.

¶3The suit is pending since the year 1998. There is no statement in the report submitted by the District Judgeship, Varanasi that there is any legal impediment in the matter. Accordingly, there is no reason why the matter is not being proceeded with for its due adjudication.

¶4Given the nature of the relief sought in this petition, it would not be appropriate to issue any specific direction upon the court concerned. However, considering that the suit is more than twenty five years old, this Court requires the trial court to ensure that the proceedings are brought to its logical conclusion, without entertaining unnecessary adjournments from the parties, in case there is no legal impediment in proceeding further and all the parties are duly served with notice of the proceeding.
