¶1Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for the Respondents No. 1 to 4.

¶2This court after hearing the matter passed an order on

08.11.2023, whereby District Basic Education Officer, Auraiya and Assistant Director, Basic Education, Kanpur Division, Kanpur were directed to appear before this court and to explain as to for what reason till date petitioner has not been allowed to join on any post pursuant to her compassionate appointment.

¶3Today personal affidavits have been filed on behalf District Basic Education Officer, Auraiya and Assistant Director, Basic Education, Kanpur Division, Kanpur. The personal affidavits are taken on record. District Basic Education Officer, Auraiya in his personal affidavit has categorically stated that petitioner pursuant to her compassionate appointment has been allowed to join on the post of Clerk in Janta Madhyamik Vidyalaya, Darbatpur Ajeetmal, District Auraiya.

¶4District Basic Education Officer, Auraiya and Assistant Director, Basic Education, Kanpur Division, Kanpur who are present before this court ensured the court that they will ensure the payment of regular salary to the petitioner.

¶5In view of the aforesaid fact that petitioner has been allowed to join pursuant to her compassionate appointment, nothing survives in this matter to be decided by this court, accordingly, this writ petition is consigned to record.
